Exclusive Representation

If your bargaining unit is not currently represented by another union or association and are interested in choosing LELS as your Exclusive Representative:

  1. Contact LELS to set up a meeting to discuss the benefits of LELS representation and the procedures to petition the Bureau of Mediation Services (BMS) for Exclusive Representation.

  2. After meeting with LELS and you make the decision to proceed, you will need to provide LELS with Authorization Forms which will indicate your desire to have LELS as your Exclusive Representative and to move forward in the process.

  3. The team at LELS will file the necessary documentation with the BMS to begin the petition process.

  4. BMS will file a “Status Quo Order” with the Employer while reviewing the petition and making a determination of representation.  A Status Quo Order will freeze everything in place until a decision has been made by the BMS.

If your bargaining unit is already represented by another union or association but are interested in the opportunity to transfer the Exclusive Representation of your bargaining unit to LELS:

During the open-window period of the contract (typically 60-120 days before the contract expires) LELS can petition the Bureau of Mediation Services for the authorization to represent you (Exclusive Representation).   For Example, if your contract expires on December 31st of a particular year, the open window period to transfer Exclusive Representation is during the months of September and October just prior to the expiration of the contract.
